Honorable Colleagues. -

I very respectfully address you, with the purpose of notifying you that in accordance with the provisions of Ministerial Resolution DM/No. 022/2023, dated November 2, 2023, Published in the Official Gazette of the Bolivarian Republic of Venezuela No. 42,762 dated November 22, 2023, changes have been established in the mechanisms to authorize imports of animals, plants and products from both origins in the following terms (Excerpts from Ministerial Resolution DM/N° 022/2023 are transcribed):

“Article 1. The validity period of the Phytosanitary and Zoosanitary Permits required for the importation of animals, plants, products and by-products of both origins, granted in accordance with the Resolution of the Ministry of Popular Power for Agriculture and Lands, today the Ministry of Popular Power for Productive Agriculture and Lands, DM/N° 164/2008 dated October 8, 2008, published in the Official Gazette of the Republic of Venezuela N° 39,033 of the same date. The period of validity referred to in this article will be counted from the date of issuance of the respective Phytosanitary or Zoosanitary Permit required for the importation of animals, plants, products and by-products of both origins.

Article 2. The Phytosanitary or Zoosanitary Permits required for the importation of animals, plants, products and by-products of both origins will be subject to the Legal Regime established in article 21 numeral 6 of Presidential Decree No. 2,647 of December 30, 2016, through which establishes the ordering of Customs Tariff goods and adopts the Common Tariff Nomenclature of the States Parties to MERCOSUR (NCM), based on the Harmonized System of Designation and Coding of Goods (HS) of the Customs Cooperation Council ( CA)- World Customs Organization (WCO), published in the Official Gazette of the Bolivarian Republic of Venezuela No. 6,281 Extraordinary of December 30, 2016 or in those dictated for this purpose by the President of the Bolivarian Republic of Venezuela.

Article 3. The permits that are in force on the date of publication of this Resolution will be valid until the date established in the same import permit for its expiration, counted from the date of its granting.

Article 4. For the importation of animals, plants, products and by-products of both origins, the interested party must have a current Import Permit, duly granted by the Ministry of Popular Power with jurisdiction in the matter of agriculture and land, through its management entity in terms of comprehensive agricultural health.

Article 5. As of the publication of this Resolution, the Phytosanitary and Zoosanitary Certificates of the country of origin will be required to refer to the number of the Import Permit granted by the National Institute of Comprehensive Agricultural Health (INSAI), attached to the Ministry of the Popular Power with jurisdiction in matters of agriculture and land, or that with jurisdiction at the moment, in matters of comprehensive agricultural health, all for the purposes of guaranteeing traceability and compliance with import health requirements, in accordance with what established in the international standards contained in the agreements and conventions signed by the Bolivarian Republic of Venezuela.

Article 6. Resolution DM/No. 164/2008, dated October 8, 2008, published in the Official Gazette of the Bolivarian Republic of Venezuela No. 39,033, of the same date, is repealed.

Article 7. This Resolution will come into force from the date of its publication in the Official Gazette of the Bolivarian Republic of Venezuela.”

In this sense, we appreciate taking note of what is established in this legal norm and collaborating as appropriate to contribute to its compliance.
