New Regulation (EU) 2016/2031 of the European Parliament and the Council of 26 October 2016 on protective measures against pests of plants has been published on 23 November 2016.
For the EU Member States it shall apply from 14 December 2019, with exemption of provisions of Article 100(3) on phytosanitary certificates for export and of Article 101(4) on phytosanitary certificates for re-export. New models of certificates as per Annex VIII A and VIII B of the regulation shall apply from 1 January 2021.
The new import rules will therefore be put into effect on 14 December 2019, when also Regulation (EU) 2017/625 on official controls will become applicable.
The most significant impact may have: - Regulation (EU) 2018/2018 on Pest Risk Assessment of high risk plants, plant products and other objects for import and - Regulation (EU) 2018/2019 establishing a provisional list of high risk plants, plant products or other objects, the import of which is banned until the PRA is available, and a list of low risk plants (fruits) for which phytosanitary certificates are not required for introduction into the EU.
