Short Description

Latvia is a member state of European Union (EU). Member states of European Union have common (uniform) plant health legislation, including phytosanitary import requirements. This means that phytosanitary import requirements are the same for all EU member states. Member states does not have their own specific import requirements. Inside EU Latvia has protected zone for fireblight (Erwinia amylovora) therefore requirements for import and movement of E.amylovora host plants are stricter than those in parts of EU where there is not such protected zone. This is also stated in common EU plant health legislation. The basis of EU plant health legislation is Regulation 2016/2031 of the European Parliament of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations No 228/2013, No 652/2014 and No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC (further in text Regulation 2016/2031, please find link below), which entered into force at the end of 2019. This regulation states main aspects of EU plant health legislation. Mayority of specific requirements and lists are placed in annexes of Commission Implementing Regulation 2019/2072 of 28 November 2019 establishing uniform conditions for the implementation of Regulation 2016/2031 of the European Parliament and the Council, as regards protective measures against pests of plants, and repealing Commission Regulation No 690/2008 and amending Commission Implementing Regulation 2018/2019 (further in text Regulation 2019/2072, please find link below). Lists that specify plants and plant products for which phytosanitary certificates are required for introduction into the EU territory, are in Annex XI, part A and part B of Regulation 2019/2072. List of plants for which phytosanitary certificates are not required is in Annex XI, part C of Regulation 2019/2072. Other commodities, corresponding "plants" definition, need phytosanitary certificates (and are included in lists of either A or B part of Annex XI). Plant products, not mentioned in part A or B of Annex XI do not require phytosanitary certificate. List of plants, plant products and other objects whose introduction into the EU is prohibited, together with countries or specific areas to which the prohibition applies is set out in Annex VI of Regulation 2019/2072. List of special requirements for introduction into the EU of certain plants, plant products and other objects, originating outside EU is set out in Annex VII of Regulation 2019/2072. List of plants and plant products whose introduction into Latvia and other Erwinia amylovora protected zones is prohibited is set out in Annex IX of Regulation 2019/2072. List of quarantine pests for the whole EU is set out in Annex II of Regulation 2019/2072. List of EU protected zones and their respective quarantine pests is in Annex III of Regulation 2019/2072. List of EU regulated non-quarantine pests and specific plants for planting, with categories and thresholds is in Annex IV of Regulation 2019/2072. There is also Commission Implementing Regulation 2018/2019 of 18 December 2018 establishing a provisional list of high risk plants, plant products or other objects, within the meaning of Article 42 of Regulation 2016/2031 (..) (please find link below). This regulation contains in its Annex I a list of high risk plants, which are forbidden to import into EU before risk analysis is done.
