25/09 Decision on the provision of the law on establishing the Croatian Center for Agriculture, Food and Rural Affairs

55/11 Article 1.

The Plant Health Act (Official Gazette 75/05 and 25/09) in Article 54, paragraph 5 shall be amended to read as follows:

"(5) An appeal against the decision of the competent inspector may be filed with the Appeals Commission at the Ministry appointed by the Government of the Republic of Croatia. An appeal shall be filed within 15 days of the date of delivery of the decision After paragraph 5, new paragraphs 6 and 7 are added, which read: "(6) The Committee, referred to in paragraph 5 of this Article, should consist of a President and two members who hold a high level of agricultural or forestry professional qualifications and have at least five years work experience and have passed a State Professional Exam for Phytosanitary inspectors, border protection inspectors or plant protection inspectors. (7) The Commission shall adopt its Rules of Procedure. Previous paragraphs 6 and 7 become paragraphs 8 and 9.
