PLAN HEALTH PROTECTION SYSTEM IN BIH

Short Description

Apart from the legal framework outlined in the Decision on establishment, the PHPO legal framework also includes:

  1. Plant Health Protection Law (BiH Official Gazette, no. 23/03);
  2. Law on Agricultural Seeds and Propagating Material of Bosnia and Herzegovina (BiH Official Gazette, no. 3/05);
  3. Law on Protection of New Plant Varieties in Bosnia and Herzegovina (BiH Official Gazette, no. 14/10 and 32/13);
  4. Law on Mineral Fertilisers (BiH Official Gazette, no. 46/04 and 76/11);
  5. Law on Phytopharmaceutical Products of BiH (BiH Official Gazette, no. 49/04);
  6. The PHPO has partial responsibility as regards the Law on Genetically Modified Organisms (Article 3 Paragraph (2) Item c), Sup-item 2)), (BiH Official Gazette, no. 23/09). Import controls

Control of import consignments, compulsory control of plant consignments, plant products and regulated establishments from List V Part B Section I, inspection of seeds and propagating materials including the protection of new plant varieties, inspection surveillance of PPS and mineral fertilisers at import to BiH is conducted by phytosanitary inspectors. Compulsory control of plant consignments, plant products and regulated establishments is performed in line with the Law on Plant Health Protection and bylaws enacted as implementing regulations of this law, namely:

  1. Rulebook on lists of harmful organisms, lists of plants, plant products and regulated establishments (BiH Official Gazette, no. 48/13);
  2. Rulebook on measures to prevent penetration and spreading and to eradicate harmful organisms on plants, plant products and regulated establishments (BiH Official Gazette, no. 59/11).
  3. Rulebook on conditions under which certain harmful organisms, plants or plant products and regulated facilities can be imported or transported/carried for the purpose of demonstration field or scientific purposes and selection of cultivars (BiH Official Gazette, no. 104/11),
  4. Rulebook on measures to prevent penetration and spreading of pine wood nematode Bursaphelenchus xylophilus ( Steiner et Buher) Nickle et al (BiH Official Gazette, no. 31/12) – aligned with Commission Decision 2006/133/EEC.
  5. Rulebook on measures to prevent penetration and spreading and to eradicate the harmful organism long-horned beetle - Anoplophora chinensis ( Foster) (BiH Official Gazette, no. 68/14) – harmonised with Commission Decision 2012/138/EC
  6. Rulebook on measures to prevent penetration and spreading of the pathogen of disease Potato Spindle tuber viroid (BiH Official Gazette, no. 30/13) – harmonised with Commission Decision 2007/410/EEC;
  7. Rulebook on measures to prevent penetration and spreading and to control potato cyst nematode in Bosnia and Herzegovina (BiH Official Gazette, no. 98/12) – harmonised with Council Directive 2007/33/EC;
  8. Rulebook on measures to prevent penetration and spreading (Synchytrium endobioticum Schilb.) Perc, of pathogen of potato cancer in Bosnia and Herzegovina (BiH Official Gazette, no. 78/09) – harmonised with Council Directive 69/464/EEC;
  9. Rulebook on implementation of systematic control and measures to prevent penetration and spreading and to control potato ring rot caused by bacteria Clavibacter michigensis. (Smith) Davis et al. ssp. sepedonicus (Spieckermann et Kotthoff) Davis et al. (BiH Official Gazette, no. 90/09) – harmonised with Council Directive 93/85/EEZ and Commission Directive 2006/56/EZ;
  10. Rulebook on implementation of systematic control and measures to prevent penetration and spreading and to control potato brown rot and bacterial wilt on potato and tomato caused by bacteria Ralstonia Solanacearum Yabuuchi et al. (BiH Official Gazette, no. 90/09) – harmonised with Council Directive 98/57/EZ and Commission Directive 2006/63/EZ. Inspection examination of agricultural seeds and propagating materials in view of meeting the quality standards is performed in accordance with the Rulebook on checking the reproduction material of agricultural plants eligible for import (BiH Official Gazette, no. 34/12).
